A man 4 times over the legal limit was arrested after he crashed into a home in DeLand, FL., police say that after the crash the homeowner pulled a .45 on the driver and shot through the windshield of the vehicle.
MyNews13 interviewed neighbor Stacy Mitchell, who saw it all happen, including the arrest of the driver once police said they determined he had a blood alcohol content of .307, nearly four times the legal limit.
Robert Gutheil, 46, was taken to the Volusia County Branch Jail on charges of careless driving and driving under the influence.
"It sounded like a big screech, and then ‘boom, boom, boom.’ Seven times," Mitchell described.
Police said Gutheil crossed High Street and Voohris Avenue and kept going onto Michael Norman's yard, crashing into the front door around 6:45 a.m.
Norman, his wife and three children, as well as a 93-year-old relative, were inside at the time, and shaken out of their beds.
Mitchell, who lives across the street, said he climbed out of bed, too, and saw the driver trying to escape.
"And you could see the car trying to back out of the house. It hit the door and went through the house," he said, adding that he called 911.
The homeowner thought a burglar was trying to break in and used his .45 caliber gun to fire at Gutheil's front windshield, police said. Gutheil wasn't hit.
The homeowner is not facing any charges for firing the gun.
