Phillip Joseph Smolinsky, 36, was arrested after his live-in girlfriend accused him of throwing a banana at her; Smolinsky immediately claimed that the woman had thrown the yellow projectile at him - but evidence on the girlfriend's face said otherwise.
According to NBC Miami, the girlfriend's face was slightly red where she said the banana hit her, an arrest affidavit said. The deputy also found the banana in the garbage and parts of the peel on the ground.
When the deputy tried to arrest Smolinsky, he resisted and had to be pepper-sprayed, authorities said.
Smolinsky was arrested for domestic battery and resisting arrest without violence, he is being held without bond until his January 9th court appearance.
