A New York man has been caught trying to spy on his wife by installing spyware on her phone prior to their divorce proceedings.
According to a report, the wife and her defense team were going over her phone looking for evidence in the court proceedings along with a computer expert who was the one that discovered the spyware. The expert found mSpy and IPVANISH.
As a result the Supreme Court ordered the husbands iPhone and computers seized to determine if he attempted to gain an advantage in the case by installing the spyware to intercept confidential and or privileged communication.
The husbands financial records were submitted to the court which showed that he had purchased the spyware two weeks before the court proceeding were to start. When he was confronted with the evidence, the husband plead the Fifth Amendment nearly 60 times.
According to court documents, a "referee" will perform an in camera inspection of the computing devices to determine if the allegations are true.
The judge has not determined what sanctions will be imposed if the accusations are confirmed.
