A man in PA., was tasered six times in a Wal-Mart parking lot during a case of mistaken identity; police mistook the 76 year old for his brother whom had been reported to be causing a disturbance at a nearby hair salon.
According to WFMZ, the suit claims police approached Robert Gross, screamed at him and threw him to the ground on his chest, causing him "pain, extreme shock, and alarm."
The suit claims Robert Gross asked police what was going on, to which police replied: "You know."
Police then shot Robert Gross six times with a Taser while he was on the ground, according to the suit.
He then was placed in a police cruiser and realized his brother Carl was being arrested.
Robert Gross is seeking more than $50,000 in damages, plus interest and other costs. The lawsuit alleges assault, battery, and deprivation of his Fourth and Fourteenth Amendment rights.
