NYPD cops hit parked car, arrest passenger for driving without license (Video)

At first glance, this incident is like a Scooby-Doo episode; 'the cop woulda got away with it, if it wasn't for that pesky CCTV video' - the one that captured the whole incident - proving that the cop "embellished" the truth a wee bit. But watch the video closely, there is more than meets the eye and the cop may not be the only one embellishing a bit..What do you think?
In the video, it appears that squad car is attempting to make it off to the side of the road before getting smacked by the oncoming box truck - this road happens to be one-way in the direction that the truck is traveling.
According to the article from Daily News, officer Christopher Oliver wrote in the criminal complaint that he "went to the driver's side door of defendant's vehicle and observed the door open and the keys in the ignition" before arresting Robert Jackson, 31, for operating a vehicle with a suspended license, according to the document.
The surveillance video Jackson obtained from a neighbor blows that out of the water; as you can see the officer never goes near the driver door - at all.
Jackson claims that only after impact did he slide across to the driver seat. Jackson was arrested and spent the night in jail. In the final result all charges were dropped against him.
If you look real close though, it doesn't appear that Jackson slid across the seat - it looks like he was sitting in the driver seat the whole time. Notice the light color of his pants that are visible in the driver side window the whole time. So it seems that both are stretching the truth a bit...
He has now filed suit against the city and the officers involved, asking for unspecified damages.
